Terms and Conditions for CarbuyingHQ – Effective Date: 22/03/2025
These Terms and Conditions (“Agreement”) govern the use of CarbuyingHQ (“we,” “us,” “our”), a website that facilitates the sale of cars from private sellers in Australia. By accessing or using our website, you agree to comply with and be bound by these terms. If you do not agree to these terms, do not use our services.
1. Service Description
CarbuyingHQ / Real deal Automotive offers a platform to sell your car quickly to us. By submitting your enquiry to us, you agree to the terms and conditions listed here.
2. Service Fee
To initiate the process of selling your vehicle through our website, there is a $99 service fee applicable, which generally comes off the price of the vehicle.
3. Payment and Contract Signing
Once you agree to the terms of the sale and both parties have signed the contract, we will make payment to you as agreed. The payment will be processed promptly after the contract is signed by both parties. The payment will be made via bank transfer and the funds will
typically be transferred to your account within 24 hours, subject to bank process times. GST may be applicable.
4. Transfer of Ownership
Once the payment is made to you, the ownership of the vehicle is considered to be transferred to carbuyingHQ or its designated buyer. You agree that from the moment payment is received, the vehicle is considered the property of carbuyingHQ and no longer the property of the seller. You are responsible for ensuring that all necessary documentation (e.g., proof of ownership, registration, and any relevant service records) is provided to us at the time of sale, as well as 2 keys and in the same state the car was during inspection.
5. Vehicle Eligibility
By submitting a vehicle for sale, you represent and warrant that:
You are the legal owner of the vehicle and have the right to sell it.
The vehicle is free of any liens, encumbrances, or legal claims.
The vehicle is in a roadworthy condition and complies with all applicable Australian safety and environmental regulations.
The information you provide about the vehicle is accurate and truthful.
If you vehicle is a previous write off we must by law be informed.
6. Fast Payment
We strive to provide fast payment upon contract signing. Once the sale contract has been executed by both parties, the payment will be processed promptly. However, we are not responsible for delays caused by external factors, including banking delays, holidays, or issues beyond our control. Generally same day payment is made, but not guaranteed.
7. No Return Policy
Once payment is made and ownership is transferred, the sale is final, and no returns or refunds will be provided. You acknowledge that once the transaction is completed, the car becomes the property of carbuyingHQ and cannot be reclaimed or exchanged.
Once the contract is signed, there will be a cancellation fee applicable, of $500.
You have the right to pull out of the sale prior to signing at anytime.
8. Privacy and Data Protection
We are committed to protecting your privacy. By using our services, you agree to the collection and use of your personal information in accordance with our Privacy Policy, which is available on our website.
9. Limitation of Liability
To the fullest extent permitted by law, carbuyinghq.com.au shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of our services, including, but not limited to, any issues with the vehicle, payment disputes, or delays.
10. Modifications to Terms
CarbuyingHQ.com.au reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be posted on this page, and the “Effective Date” at the top of the page will be updated. By continuing to use our services after changes are posted, you accept
the modified Terms and Conditions.
CarbuyingHQ / Real Deal Autos reserves the right to terminate any agreement or contract at anytime.
11. Governing Law
This Agreement will be governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising out of or related to these Terms and Conditions shall be resolved exclusively in the courts located in Victoria, Australia.
Security act
The Seller acknowledges that:
∙this agreement constitutes a security agreement for the purposes of the PersonalProperty Securities Act 2009
∙RDA has a security interest in the Vehicle supplied under this agreement.; and
∙Real deal autos may register a security against the vehicle once the contract is signed and the money transferred.
